There is not a ban on talking on cell phones while driving, except for teenage drivers.
In June 2009, the N.C. General Assembly passed a law that bans drivers from sending and reading text messages while driving. The new law takes effect on Dec. 1 and conviction of a violation carries a $100 fine plus court costs.
Drivers under 18 years old are banned under state law from talking or text messaging while driving.

If N.C. really wanted to stop texting while driving then the fine would be a lot higher than 100 dollars! It has been found in many studies that texting while driving is as dangerous as driving under the influence, an offense that carries a much higher fine and punishment!
