Q. What are the legalities regarding trees that border a property line? Is the owner or renter of a property that borders another property, responsible for leaf pickup?
A. Any debris that falls into your yard from a neighbor’s tree is your responsibility to pick up, answers Dylan Lee, GTV Manager in the Wilmington City Hall Communications Office. This includes leaves, branches, twigs, and other debris.
If a neighbor’s tree hangs over your property, you have the right to cut the branches on your side of the property, Lee said. Any other issues regarding trees near property lines are civil matters – unless a tree is deemed to be a public nuisance, he added.
