Q. How long do political candidates have to remove their roadside signs after an election? What is the fine? Who enforces this?

A. The rules vary somewhat by jurisdiction.

The city of Wilmington has an ordinance that says political signs must be removed 30 days following the applicable election or referendum. After that, signs may be removed by city code enforcement and taken to the city’s complex at the intersection of South 17th and Marstellar streets, said Malissa Talbert, a city spokeswoman.

Political signs are not allowed on city rights-of-way, said Steve Harrell, the city’s community services director. In the past, those signs have simply been removed and the city has not levied a fine, Harrell said.

In New Hanover County, signs must be removed within 30 days after the election, said Linda Painter, a county code compliance official.

If signs are not removed, a candidate may receive a letter that says the sign needs to be removed. If it is not removed, the county could issue a $100 fine, Painter said.

The state allows political signs on the rights-of-way of state-maintained roads, although state law says the signs may only be placed in a period beginning the 30th day before the start of early voting and 10 days after the primary or election day.
