Q. Is New Hanover County allowed to post a job listing on its website for only a few hours? Is this a way for the county to get around fair hiring practices? I just saw that they posted an HR analyst position at 6 p.m. with a closing date of the same day at 11: 59 p.m.
A. In most cases, New Hanover County is not required to advertise position openings before making a hiring decision, according to county spokesperson Charles Smith.
But there are “posting” requirements for state government employment, and in select county agencies covered by the state personnel act, such as the social services and public health departments. For these positions, counties are under a positive obligation to publicize vacancies as governed by statute and administrative code provisions, Smith said.
The human resources analyst position does not fall under that category, but it was posted for four days. Smith said the job was posted on Tuesday, March 18, and closed Friday, March 21, at 11:59 p.m. The position received 164 applications.
The specifics on job posting requirements for government agencies can be found in state general statutes 96-29 and 126-7.1. Additional administrative code provisions are 25 NCAC 1H.0631 and 25 NCAC 1I.1902.
