Why is Howard Armistead of Pender County allowed to be on the ABC board in Belville?

Jason Gonzales

Q. Why is Howard Armistead allowed to be on the ABC board in Leland? He was not put back on the New Hanover County ABC board because he lives in Pender county. So why is he allowed to be another board in a county in which he does not live?

A. Howard Armistead is legally able to serve on the Belville ABC Board, according to Athina Williams, town administrator.

According to state statute, Armistead is not in violation of any law while serving on the town’s board.

Williams highlighted two sections of the law that allows Armistead to serve on the board under N.C.G.S. 18B-700(d).

The state statute says the “city ABC board members shall be appointed by the city governing body, unless a different method of appointment is provided in a local act enacted before the effective date of this Chapter.”

And the qualifications of a member are “the appointees’ interest in public affairs, good judgment, knowledge, ability, and good moral character.”

UPDATE: Howard Armistead Jr. resigned his position as Belville ABC Board chairman on July 31, 2014. Read the story here.
