Q. Can New Hanover County sheriff’s deputies or Wilmington Police Department officers patrol private gated community roads such as Landfall and Figure Eight Island without permission from their respective HOA office? And while patrolling, can they pull over motorists for any violations?
A. “As as far as the New Hanover County Sheriff’s Office, we are allowed into any neighborhood to carry out the duties of the sheriff,” Sgt. Jerry Brewer said.
That being said, Brewer added, “It is not a practice of (sheriff’s deputies) to patrol in a private gated community such as Landfall or Figure Eight. But if a deputy is in the community, for example serving civil papers or following up on an investigation, and witnesses a North Carolina law being broken, they can enforce that law.”
The New Hanover County Sheriff’s Office “does not need the permission of any HOA to enforce North Carolina law,” Brewer said.
