Why are police in Wrightsville Beach allowed to ride ATVs without a helmet?

It’s true that police officers in Wrightsville Beach typically don’t wear helmets while operating all-terrain vehicles while patrolling the beach strand and sometimes public streets. While North Carolina law requires ATV operators to wear helmets, police officers and anyone else lawfully operating an all-terrain vehicle on any beach area where such vehicles are allowed are exempt from wearing helmets, according to N.C. General Statute 20-171.22. Also, a state statute says law enforcement officers acting in the scope of their duties can operate ATVs on public roads where the speed limit is 35 mph or less. Police Chief John Carey said he wouldn’t want his officers or even lifeguards, who are managed by the police department, to wear helmets in extreme heat.

“It’s too hot for them to wear a helmet on the beach strand,” he said.

So does that mean in extreme heat we can ride our motorcycles down Lumina Ave with no helmet if we stay below 35 mph? I mean, the chief wouldn’t want anyone to be that hot, right?

Sam, feel free to ride down Lumina or any other road any time you want to without a helmet. You are going to do exactly what you want to do anyway. I need to write some citations anyway!

I think it should be about public appearance. The laws point of view it should cover all citizens. Not just law abiding induviduals?? In my childrens point of view an officer is “cool” so lets not give them the wrong idea…..put those helmets on!!!
